Terms of use
Agreement to terms
Please read these Terms of Use (the “Terms”) carefully before accessing or using any FreeSolitaireHub.com websites, games, services or related offerings. These Terms are a legally binding agreement between you, whether acting individually or on behalf of an entity (“User,” “you” or “your”), and FreeSolitaireHub.com (“FreeSolitaireHub.com,” “we,” “us” or “our”) (together, the “Parties”).
A “User” is any person or entity that visits a FreeSolitaireHub.com website, plays games through our services, or otherwise uses the Site or Platform. You don’t need an account to play: the site has no sign-up and no login.
FreeSolitaireHub.com operates a web-based gaming platform (the “Platform”). These Terms govern your access to and use of our websites and Platform, including FreeSolitaireHub.com, together with any related media form, media channel, mobile website, mobile application or other service that is linked or connected to the Site or Platform (together, the “Site”).
BY ACCESSING OR USING THE SITE OR PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREED TO THESE TERMS. THESE TERMS APPLY THROUGHOUT YOUR USE OF THE SITE AND PLATFORM. IF YOU DO NOT ACCEPT ALL OF THESE TERMS, YOU MUST NOT USE THE SITE OR PLATFORM AND MUST STOP USING IT IMMEDIATELY.
Age requirements
The Site is intended for a general audience and is not directed at children. You must be at least thirteen (13) years old, or the minimum age required in your country of residence if that is higher, to use the Site. We do not knowingly collect personal information from children below that age.
If you are under the age of majority where you live, you may use the Site only with the involvement and consent of a parent or legal guardian, who must review and agree to these Terms on your behalf.
Changes to these Terms
Any supplemental terms, policies or other documents published on the Site from time to time are incorporated into these Terms by reference and, together with these Terms, form the entire agreement concerning your use of the Site.
We may change these Terms at any time and for any reason. When we do, we will update the “Last updated” date at the top of this page. For material changes we may also tell you in another reasonable way, such as a notice on the Site. You are responsible for reviewing these Terms from time to time. If you keep using the Site after revised Terms are posted, you accept the revised Terms.
The Site is not intended for distribution to, or use by, any person or entity in a country where that distribution or use would break the law or would require FreeSolitaireHub.com to register there. Anyone who chooses to access the Site from another location does so on their own initiative and is responsible for complying with local laws, to the extent they apply.
Privacy policy
Information collected through your use of the Site and Platform is governed by our Privacy Policy, which explains what we collect, how we use and protect it, and your rights. Please read it alongside these Terms.
Intellectual property rights
Unless otherwise stated, the Site and Platform are the property of FreeSolitaireHub.com. All source code, software, functionality, website designs, card artwork, audio, text, graphics and other materials on the Site (the “Content”), and the trademarks, service marks and logos displayed on it (the “Marks”), are owned or controlled by us or licensed to us. Some Content, such as the Manrope typeface, is provided by third parties under their own licences, which continue to apply to it. The rules of Klondike solitaire are traditional and are not claimed by us.
The Content and Marks are protected by copyright, trademark and other intellectual property laws of Canada, the United States, other international countries and international conventions.
Provided that you are eligible to use the Site, we grant you a limited, non-exclusive, non-sublicensable, non-transferable and revocable licence to access and use the Site and Platform, and to print or save a copy of pages of the Content you have properly accessed, solely for your personal, non-commercial use.
Except as these Terms allow, no part of the Site, Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed or otherwise exploited for any commercial purpose without our express prior written permission. This includes the game itself and its visual design.
All rights not expressly granted to you in these Terms are reserved by FreeSolitaireHub.com. Nothing in these Terms prevents us from making the Platform available to anyone else.
Points and game progress
- Points have no cash value. Points earned in the game are a free, in-game feature only. They cannot be bought with money, sold, exchanged for money or anything of value, or transferred to another person, and they are not your property.
- Points live on your device. Your game, settings, statistics and points are saved only in your own browser or app on your device. We don’t receive or back them up. They can be lost if you clear your browser data, use private browsing, switch device or browser, or uninstall the app, and we can’t restore them.
- We can change the points system. We may change how points are earned or spent, or reset, limit or remove points or the points system, at any time.
User representations
By using the Site or Platform, you represent and warrant that:
- you have the legal capacity to agree to these Terms, or a parent or guardian has agreed to them for you as described in “Age requirements”;
- your use of the Site and Platform will not violate any applicable law or these Terms; and
- any information you send us, for example in an email, is true, accurate and complete.
Prohibited activities
You may use the Site and Platform only for the purposes for which they are provided. Without limiting that, you agree that you will not:
- use the Site or Platform for any illegal or unauthorised purpose;
- remove, disable, bypass or circumvent any technical safeguard or security measure on the Site or Platform;
- cheat, for example by editing stored game data or points, or by using bots, scripts or other automated tools to play the games;
- without our prior written consent, use any robot, spider, scraper or other automated tool to copy, harvest or monitor the Site or Platform in bulk, copy the game or its Content, or use any part of the Site or its Content to build datasets or to train machine-learning or artificial-intelligence models;
- click on ads, or generate ad impressions or clicks, by automated means or in any way meant to inflate ad statistics or earnings, or encourage anyone else to do so;
- interfere with, disrupt or place an unreasonable load on the Site, its servers or its networks, or attempt to gain unauthorised access to them;
- frame or mirror the Site or present it as part of another site or service; or
- use the Site or Platform in connection with any commercial endeavour that we have not specifically approved.
Search engines, and AI assistants that read public pages to answer a user’s question and link back to us, may access the Site as our file allows. This does not permit the bulk copying or AI training described above.
Submissions
Any questions, comments, suggestions, ideas, feedback or other information about the Site or Platform that you send us (“Submissions”) are non-confidential. You grant us a perpetual, irrevocable, worldwide, royalty-free licence to use, copy and act on Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. To the extent permitted by law, you waive any moral rights in your Submissions. You represent that each Submission is original to you or that you have the right to send it to us.
Copyright complaints
We respect intellectual property rights. If you believe in good faith that material on the Site infringes your copyright, you or your authorised agent may contact us using the internet web contact form with the subject “Copyright complaint” and include:
- your physical or electronic signature, as the owner of the copyright or a person authorised to act for the owner;
- identification of the copyrighted work you believe has been infringed;
- identification of the material you believe is infringing and where it appears on the Site (for example, its web address);
- your name, postal address, telephone number and email address;
- a statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law; and
- a sworn affidavit statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner.
If we remove or restrict material in response to a notice and you believe this was a mistake, you may send a counter-notice to the same address that includes your physical or electronic signature; identification of the material and where it appeared before it was removed; a statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake or misidentification; and your name, address and telephone number. We may share notices and counter-notices with the other party.
We will review each notice and act as we consider appropriate, which may include removing or restricting access to the material. Knowingly sending a false notice or counter-notice may make you liable for damages. You may wish to consult a legal adviser before sending one.
Site management
We reserve the right, but not the obligation, to:
- monitor the Site and Platform for violations of these Terms;
- take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms, including reporting them to law enforcement authorities;
- remove, disable or restrict any content or feature that we consider inappropriate, without notice or liability; and
- otherwise manage the Site and Platform to protect our rights and property and to keep them working properly.
Suspension and termination
WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS, WE RESERVE THE RIGHT, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, TO DENY, RESTRICT OR END ANY PERSON’S ACCESS TO OR USE OF THE SITE OR PLATFORM, INCLUDING BY BLOCKING PARTICULAR IP ADDRESSES OR REGIONS, FOR ANY REASON OR FOR NO REASON, INCLUDING A BREACH OF THESE TERMS OR OF ANY APPLICABLE LAW.
We will not be liable to you or any third party for ending your access to the Site or Platform. In addition, we may pursue any appropriate legal remedies, including civil, criminal and injunctive relief.
Modifications and interruptions
We may change, update, suspend or discontinue any part of the Site or Platform, or the whole of it, at any time and for any reason without notice, and we have no obligation to update information on it. We will not be liable to you or any third party for any modification, suspension or discontinuation.
We do not guarantee that the Site or Platform will always be available. Hardware, software, maintenance or other problems may cause interruptions, delays or errors. You agree that we have no liability for any loss, damage or inconvenience caused by your inability to access or use the Site or Platform during any downtime or discontinuation. Nothing in these Terms obliges us to maintain or support the Site or Platform or to provide corrections, updates or releases.
Advertising and third-party links
The Site is supported by advertising and may contain ads and links to websites, apps and services run by third parties. We don’t control and are not responsible for third-party content, products, services or privacy practices, and a link or ad is not an endorsement. Any dealings you have with an advertiser or other third party are solely between you and them.
Corrections
Information on the Site or Platform may contain typographical errors, inaccuracies or omissions. We reserve the right to correct them and to change or update information at any time without prior notice.
Disclaimer
THE SITE AND PLATFORM ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS, FREE OF CHARGE. YOU AGREE THAT YOUR USE OF THE SITE AND PLATFORM IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, RELATING TO THE SITE, THE PLATFORM AND YOUR USE OF THEM, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE MAKE NO WARRANTY ABOUT THE ACCURACY OR COMPLETENESS OF THE CONTENT ON THE SITE OR OF ANY WEBSITE LINKED TO IT.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ASSUME NO LIABILITY OR RESPONSIBILITY FOR:
- errors, mistakes or inaccuracies in content or materials;
- personal injury or property damage of any kind resulting from your access to or use of the Site;
- any unauthorised access to or use of our servers;
- any interruption or cessation of transmission to or from the Site or Platform;
- bugs, viruses, Trojan horses or similar harmful code that a third party may transmit to or through the Site; or
- the loss of game progress, settings, statistics or points stored on your device.
WE DO NOT WARRANT, ENDORSE, GUARANTEE OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SITE, ANY LINKED WEBSITE, OR ANY WEBSITE OR APP FEATURED IN AN ADVERTISEMENT, AND WE ARE NOT A PARTY TO ANY TRANSACTION BETWEEN YOU AND A THIRD PARTY.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER FREESOLITAIREHUB.COM NOR ITS OWNERS, DIRECTORS, EMPLOYEES, PARTNERS, LICENSORS, CONTRACTORS, SUPPLIERS, AGENTS OR AFFILIATES WILL BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOSS OF USE OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE, THE PLATFORM OR THESE TERMS, WHATEVER THE FORM OF THE CLAIM, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE AND (B) ONE DOLLAR ($1).
Some jurisdictions do not allow limits on implied warranties or the exclusion or limitation of certain damages. If those laws apply to you, some or all of the disclaimers and limitations above may not apply, and you may have additional rights. Nothing in these Terms limits rights you have under consumer protection laws that cannot be limited by contract, or our liability for fraud, gross negligence, wilful misconduct, or death or personal injury caused by our negligence, where the law does not allow that liability to be limited.
Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless FreeSolitaireHub.com and its owners, affiliates, officers, agents, partners and employees from and against any loss, damage, liability, claim or demand, including reasonable legal fees and expenses, made by any third party and arising out of:
- your use of the Site or Platform in breach of these Terms;
- your breach of these Terms or of the representations and warranties in them; or
- your violation of the rights of a third party, including intellectual property rights.
We may, at your expense, assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defence. We will use reasonable efforts to notify you of any such claim once we become aware of it.
Governing law
These Terms and your use of the Site and Platform are governed by the laws applicable in Canada, United States, European Union and International countries, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
Dispute resolution
Talk to us first. If you have a dispute, claim or controversy with us arising out of or relating to these Terms, the Site or the Platform (a “Dispute”), please first use the internet web contact form, with a short description of the Dispute and how you would like it resolved. Both Parties agree to try in good faith to resolve the Dispute informally for at least thirty (30) days before starting court proceedings, except where a Party needs urgent injunctive relief or to protect its intellectual property rights.
Courts. If a Dispute is not resolved informally, it will be decided by the competent local representative courts, and you and we submit to the jurisdiction of those courts. Either Party may instead bring an individual claim in a small claims court where it qualifies.
Individual claims. To the fullest extent permitted by law, Disputes will be brought and decided only on an individual basis, and not as a plaintiff or class member in any purported class, collective or representative proceeding.
Consumers in other countries. Nothing in these Terms deprives you of the protection of mandatory laws of the country, province or state where you live that cannot be changed by contract, or of any right you have under those laws to bring proceedings in your local courts. In particular, if you live in the European Union, the United Kingdom or Switzerland, you may rely on the mandatory consumer protection laws of your country of residence and bring proceedings in its courts; if you live in Canada, United States or other such international countries, the provisions of local consumer protection laws apply, including your right to go to court and to take part in a class action.
Electronic communications
Visiting the Site, using our internet web contact form and emailing us are electronic communications. You consent to receive communications from us electronically and agree that all agreements, notices, disclosures and other communications we provide electronically, by email or on the Site, satisfy any legal requirement that such communications be in writing. To the extent permitted by law, you agree to the use of electronic records and the electronic delivery of notices and policies.
Miscellaneous
These Terms, together with our Privacy Policy and any other policies or operating rules we post on the Site, are the entire agreement between you and FreeSolitaireHub.com about the Site and Platform. Our failure to exercise or enforce any right or provision of these Terms is not a waiver of it. These Terms operate to the fullest extent permitted by law. We may assign any or all of our rights and obligations to another party at any time. We are not responsible for any loss, damage, delay or failure to act caused by anything beyond our reasonable control. If any provision, or part of one, is found unlawful, void or unenforceable, it is severable and does not affect the rest. Nothing in these Terms creates a joint venture, partnership, employment or agency relationship between you and us. These Terms will not be interpreted against us just because we wrote them. You waive any defence based on the electronic form of these Terms or on the lack of physical signatures.
